It is important to understand that a divorce is a separate legal process and does not resolve parenting or property issues.
A divorce severs a marriage and for a divorce to be granted, a married couple must prove that the marriage has broken down irretrievably. This test is satisfied if a couple can establish that they have lived separately for at least one year prior to making an Application for Divorce.
In marriages where there are children under the age of 18 years, the parties must satisfy the Court that there are satisfactory arrangements for the future care of the children before a divorce will be granted.
